These Terms of Use govern your use of www.plantanapp.com (the “website”), operated by Plant an App, Inc. (“Plant an App,” “we,” “us”). By using the website, you agree to them. If you use it on behalf of an organization, you agree on the organization’s behalf. If you don’t agree, please don’t use the website.
How we handle personal information is described in our Privacy Policy.
Our products have their own agreements
These terms cover the website only. Your use of the Plant an App platform, including trials, support, and professional services, is governed by the agreement you sign with us or with one of our partners. If that agreement and these terms ever conflict, that agreement wins.
Information on the website
We describe our products and services as accurately as we can, but the website is general information. Features, capabilities, and availability can change, and can depend on how a system is built, configured, and licensed. Nothing on the website is an offer, a warranty, or a commitment. Our commitments are the ones in a signed agreement.
The examples and illustrations on the website, including the organizations, people, addresses, records, and data shown in them, are fictitious, unless we say otherwise. Any resemblance to real ones is unintended.
Using the website
You may use the website for lawful purposes. You agree not to:
- use it in a way that breaks any law or regulation, or infringes anyone’s rights;
- disrupt, overload, or impair it, or interfere with anyone else’s use of it;
- try to reach parts of it, or systems behind it, that aren’t meant to be public;
- probe, scan, or test its vulnerabilities without our written permission;
- collect content or information from it by automated means, except search engines indexing it within our robots.txt rules;
- upload or send malware, or anything else meant to cause harm;
- submit information that’s false, or that you have no right to share, or pretend to be someone else.

Our content and trademarks
The website and its content (text, graphics, illustrations, videos, documents, and code) belong to Plant an App or its licensors, and are protected by copyright and other laws. You may view, download, and print content from the website for your own use, or to evaluate our products for your organization, as long as you keep any copyright and other notices. Any other use needs our written permission.
“Plant an App” and the Plant an App logo are trademarks of Plant an App, Inc. Other names and logos on the website belong to their owners.
If you believe something on the website infringes your copyright or other rights, tell us at legal@plantanapp.com, and we’ll look into it promptly.
What you send us
When you send us information through the website’s forms or otherwise, you confirm it’s accurate and that you have the right to share it, including any information about other people. Please don’t send confidential information through the website’s forms; if we need it, we’ll agree with you on how to exchange it.
If you give us feedback or suggestions about our products or the website, we may use them freely, without any obligation to you.
Other websites and services
The website links to other websites, and uses services from other companies, such as videos hosted by YouTube. We don’t control them, and we’re not responsible for their content or practices. A link doesn’t mean we endorse a website. Your use of other websites and services is governed by their own terms.
Disclaimers
The website and its content are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don’t warrant that the website will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current.
Limitation of liability
To the fullest extent the law allows, Plant an App and its affiliates, licensors, and suppliers won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or relating to the website or these terms, whatever the legal theory, and even if we were told such damages were possible. Our total liability arising from or relating to the website or these terms is limited to one hundred US dollars (US$100).
Nothing in these terms limits liability that can’t be limited under applicable law, such as liability for fraud, or for death or personal injury caused by negligence.
Government users
If you use the website on behalf of a government entity, and the law that applies to that entity doesn’t allow it to accept a provision of these terms, such as the governing law, venue, or limitation of liability, that provision applies to the entity only to the extent the law allows, and the rest of these terms still apply.
Changes and suspension
We may change the website, or stop offering any part of it, at any time. We may also update these terms; when we do, we’ll post the new version here with a new “last updated” date. Changes apply from then on, so by continuing to use the website, you accept them.
We may suspend or restrict anyone’s access to the website if they break these terms.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from or relating to the website or these terms, and you consent to their jurisdiction. Either party may still seek urgent relief, such as an injunction, in any court that has jurisdiction.
General
These terms, together with our Privacy Policy, are the entire agreement between you and Plant an App about the website. If a provision is found unenforceable, it will be enforced to the extent possible, and the rest of these terms will remain in effect. If we don’t enforce a provision, that isn’t a waiver of it. You may not transfer your rights under these terms; we may transfer ours to an affiliate or a successor business. These terms are written in English, and the English version controls over any translation.
